1. Acceptance of Terms

By accessing and using Transcribly ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.

2. Service Description

Transcribly provides AI-powered audio transcription services. We convert your audio files into text format using advanced speech recognition technology.

3. Data Retention & Storage Policy

3.1 Free Plan Users

• Storage Duration: Transcription files (audio + text) are stored for 30 days from the creation date.
• Automatic Deletion: After 30 days, files are automatically and permanently deleted from our servers.
• Download Responsibility: You must download your files before the 30-day expiry period to retain them.
• No Recovery: Once deleted, files cannot be recovered. We do not maintain backups of expired files.

3.2 Paid Plan Users (Pro & Premium)

• Active Subscription: Files are stored indefinitely as long as your subscription remains active and in good standing.
• Grace Period: Upon subscription cancellation, you have a 45-day grace period to download all your files.
• Post-Grace Deletion: After the 45-day grace period, all files are permanently deleted from our servers.
• Payment Failures: If your payment fails and subscription lapses, the 45-day grace period begins immediately.

4. Usage Limits

4.1 Monthly Transcription Minutes

• Free Plan: 120 minutes per month
• Monthly Plan ($12/month): 1,200 minutes per month (20 hours)
• Yearly Plan ($99/year): 15,000 minutes per year (250 hours)

4.2 Per-File Limits

• All Plans: Maximum 120 minutes per file (no file size limit)

4.3 Usage Tracking

• Usage is tracked on a calendar month basis (resets on the 1st of each month)
• Once minutes are used, they cannot be refunded or rolled over
• Deleting transcriptions does not restore used minutes

5. User Responsibilities

• You are responsible for maintaining backups of your important transcriptions
• You must download files before they expire
• You are responsible for maintaining valid payment information for paid plans
• You must comply with all applicable laws when using the Service
• You must not upload copyrighted content without permission

6. Payments & Refunds

• Paid subscriptions are billed monthly or annually in advance
• All payments are processed securely through Stripe
• Refunds are provided at our discretion within 7 days of purchase
• No refunds for unused minutes or partial months
• You can cancel your subscription at any time

7. Data Privacy & Security

• Your audio files and transcriptions are stored securely on our servers
• We use industry-standard encryption for data transmission and storage
• We do not share your data with third parties without your consent

8. Service Availability

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• We reserve the right to perform maintenance with reasonable notice
• We are not liable for service interruptions beyond our control

9. Termination

• We reserve the right to suspend or terminate accounts that violate these terms
• You can close your account at any time
• Upon account closure, all data will be deleted according to our retention policy

10. Limitation of Liability

The Service is provided "as is" without warranties of any kind. We are not liable for any damages arising from the use or inability to use the Service, including but not limited to lost data, lost profits, or business interruption.

11. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
